TERMS OF USE

These Terms of Use (“Terms”) form a legally binding agreement between Golf Caravans Pty Ltd (ABN 76 141 346 705) (“Golf”, “we”, “us” or “our”) and every person who accesses or uses the website located at golfcaravans.com.au, together with any associated webpages, customer portals, online tools, downloadable resources and digital services (collectively, the Site).

Golf is an Australian manufacturer of premium recreational vehicles, producing a range of caravans, pop tops, motorhomes, accessories and related products. These Terms govern your access to and use of the Site. By accessing or using the Site, submitting an enquiry, requesting a quotation, downloading product information, registering a warranty, creating an online account, uploading documents, posting reviews or otherwise interacting with the Site, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Site. Nothing contained in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (“ACL”) or any other applicable legislation where those rights cannot legally be excluded.

Definitions

In these Terms, unless the context otherwise requires: ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth). Authorised Dealer means a dealer authorised by Golf to market, promote or sell Golf Products. Content means all information made available through the Site, including text, graphics, photographs, videos, brochures, specifications, manuals, logos, software, downloadable resources and other materials. Customer means any person who purchases, owns, enquires about or otherwise interacts with Golf Products or services. Products means the recreational vehicles, accessories, replacement parts and related goods manufactured, supplied or marketed by Golf. Site means golfcaravans.com.au, together with all associated webpages, online portals, applications and digital services operated by Golf. Terms means these Terms of Use, as amended from time to time. User, you or your means every individual or entity who accesses or uses the Site.

Acceptance of These Terms

These Terms apply to every visitor, customer, supplier, dealer and other person accessing or using the Site. By using the Site, you agree to comply with these Terms and all applicable laws. If you access the Site on behalf of a company, partnership, trust or other organisation, you warrant that you have authority to bind that organisation to these Terms. Separate agreements may apply to the purchase of Products, warranties, finance applications, servicing, promotions or other commercial transactions. Where a separate written agreement applies, that agreement prevails to the extent of any inconsistency. Golf may update these Terms from time to time to reflect changes to legislation, business operations, Products or website functionality. Updated Terms become effective when published on the Site unless otherwise stated. Your continued use of the Site after any update constitutes acceptance of the revised Terms.

Eligibility and Accounts

You must be at least eighteen (18) years of age to create an account, register a warranty, upload documents, submit reviews or use any interactive functionality available through the Site. Where you use the Site on behalf of another person or organisation, you warrant that you have authority to do so. Certain features of the Site may require an online account. You agree to provide accurate, complete and current information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account unless caused by Golf’s negligence or a failure of our systems. You must notify Golf as soon as reasonably practicable if you suspect unauthorised access to your account. Golf may suspend or terminate accounts where reasonably necessary to protect the security, integrity or lawful operation of the Site.

Permitted Use of the Site

The Site is intended to provide information about Golf, our Products, Authorised Dealers and related services. Subject to these Terms, you may use the Site to: • learn about Golf Products; • compare product models and specifications; • download brochures and owner resources; • locate an Authorised Dealer; • submit enquiries or request quotations; • register warranties or service requests; and • access other online services made available by Golf. You must use the Site responsibly, lawfully and in a manner that does not interfere with other users or the operation of the Site. You must not use the Site for any unlawful or fraudulent purpose, interfere with its security, attempt unauthorised access, introduce malicious software, scrape or harvest Content without permission, impersonate another person or reproduce Site Content for commercial purposes without Golf’s prior written consent. Golf reserves the right to investigate suspected misuse of the Site and take reasonable action to protect its systems, users and intellectual property.

Product Information and Specifications

Golf uses reasonable efforts to ensure that information published on the Site is accurate and current at the time of publication. However, all product information is provided as general information only. Specifications, dimensions, layouts, weights, capacities, finishes, colours, appliance models, optional equipment, standard inclusions, availability and pricing may vary between model years, production runs and individual recreational vehicles. Photographs, videos, virtual tours, brochures and promotional material are illustrative only and may include optional accessories, upgraded finishes or dealer-installed equipment that are not included as standard. Published specifications are subject to reasonable manufacturing tolerances, engineering improvements, supplier substitutions and regulatory requirements. Golf reserves the right to modify Products, specifications, standard inclusions and available options without prior notice where reasonably necessary for product development, manufacturing, safety or compliance purposes. Customers should rely on approved quotations, sales documentation, compliance information and owner’s manuals rather than indicative website information when making purchasing or operational decisions.

Quotes, Pricing and Orders

The Site may enable you to request quotations, submit enquiries, register your interest in a Product or locate an Authorised Dealer. Unless expressly stated otherwise, all information made available through the Site is provided for general information purposes only and does not constitute a legally binding offer. Submitting an enquiry, requesting a quotation or expressing interest in a Product does not create a contract between you and Golf. A binding agreement is formed only when an order has been accepted in writing by Golf or an Authorised Dealer and is governed by the applicable sales documentation and any related terms and conditions. Prices, estimated delivery dates, promotional offers, finance examples, trade-in information and Product availability displayed on the Site are indicative only and may change without notice. Variations may occur due to changes in manufacturing costs, supplier pricing, freight charges, taxation, exchange rates, regulatory requirements or ongoing product development. Golf reserves the right to correct pricing errors, typographical mistakes or inaccurate information published on the Site at any time. Any promotions or special offers advertised on the Site are subject to their own terms and conditions, participating dealers, availability and applicable promotional periods.

Authorised Dealers

Golf distributes its Products through a network of Authorised Dealers located throughout Australia. Authorised Dealers are independent businesses. Unless expressly agreed in writing, they are not employees, agents or representatives of Golf for the purpose of entering contracts, collecting payments or making representations on Golf’s behalf. Individual dealers may determine their own retail pricing, delivery charges, trade-in valuations, finance arrangements, accessory packages and customer service processes. Where you submit an enquiry through the Site, Golf may respond directly or refer your enquiry to an appropriate Authorised Dealer based on your location, requested Product or service requirements. Any personal information shared for this purpose will be handled in accordance with Golf’s Privacy Policy. Golf is not responsible for representations, warranties or commitments made independently by an Authorised Dealer unless those representations have been expressly authorised in writing.

Customer Submissions and Online Services

The Site may allow you to upload or submit documents, photographs, specifications, warranty information, reviews, enquiries or other material in connection with Product enquiries, customer support, warranty claims, service requests or other online services (“User Submissions”). You retain ownership of your original User Submissions. However, by submitting material through the Site, you grant Golf a non-exclusive, worldwide, royalty-free licence to use, reproduce, store, adapt and communicate that material for purposes including: • responding to your enquiry; • preparing quotations; • assessing Product suitability; • warranty administration; • servicing and technical support; • product quality assurance; • product development; and • improving our Products and customer experience. You warrant that your User Submissions: • belong to you or that you have authority to provide them; • do not infringe another person’s intellectual property or privacy rights; • are accurate to the best of your knowledge; • comply with applicable laws; and • do not contain malicious software or harmful code. Golf may remove, edit or decline User Submissions where reasonably necessary to protect the Site, comply with legal obligations or maintain the integrity of our online services.

Warranty Registration and Customer Support

The Site may provide online access to warranty registration, owner resources, service requests, replacement parts enquiries, technical support and other customer services. You agree to provide complete, accurate and current information when using these services. Golf may request supporting documentation, including proof of purchase, photographs, service history or compliance information, where reasonably required to assess a warranty claim or customer request. Submitting a warranty registration or warranty claim through the Site does not automatically establish entitlement to warranty coverage. All warranty claims remain subject to inspection and assessment under the applicable warranty terms. Any warranty provided by Golf operates in addition to your rights under the Australian Consumer Law.

Recreational Vehicle Safety

Safe ownership and operation of a recreational vehicle requires appropriate care, maintenance and compliance with applicable laws. Owners and operators are responsible for ensuring Products are operated, maintained and serviced in accordance with applicable legislation, owner’s manuals and manufacturer recommendations. Customers remain responsible for ensuring: • tow vehicles are legally suitable for towing the selected Product; • payload, axle load and tow ball weight limits are observed; • safety equipment is correctly installed and maintained; • Products are inspected before travel; and • maintenance is carried out at appropriate intervals. Unauthorised structural modifications, suspension alterations, gas or electrical modifications, chassis changes or incompatible aftermarket accessories may affect safety, regulatory compliance and warranty coverage. Information published on the Site is intended as general information only and should not replace professional engineering, mechanical, towing or safety advice where required.

User Reviews and Community Content

Where the Site allows users to submit reviews, ratings, comments or other public content, that content must be lawful, respectful and based on genuine customer experience. You must not publish material that is false, misleading, defamatory, discriminatory, offensive, unlawful or that infringes another person’s rights. By submitting reviews or other public content, you grant Golf a perpetual, worldwide, royalty-free licence to reproduce, publish, edit, adapt and use that content for purposes including customer communications, product improvement, marketing and promotional activities. Golf reserves the right, but is not obliged, to moderate, edit or remove user-generated content where reasonably necessary to maintain the quality, integrity or lawful operation of the Site. Publication of user-generated content does not imply endorsement by Golf.

Intellectual Property

Unless otherwise stated, all intellectual property appearing on the Site, including text, graphics, photographs, videos, brochures, manuals, specifications, software, logos, Product names, website design and other Content, is owned by or licensed to Golf and is protected under applicable intellectual property laws. You are granted a limited, revocable, non-exclusive licence to access and use the Site for your personal, lawful and non-commercial use. Except where permitted by law or with Golf’s prior written consent, you must not reproduce, distribute, modify, publish, sell, create derivative works from or otherwise commercially exploit any Content made available through the Site. Any ideas, suggestions or feedback voluntarily provided to Golf regarding the Site or our Products may be used by Golf without restriction or any obligation to compensate you.

Privacy

Disclaimers

The Site is provided on an “as is” and “as available” basis. While Golf takes reasonable care to ensure that information published on the Site is accurate and current, we do not warrant that the Site will always be available, uninterrupted, secure or free from errors, omissions, viruses or other harmful components. The information published on the Site is provided for general information purposes only and should not be relied upon as engineering, legal, financial, taxation, mechanical, towing or other professional advice. Product specifications, dimensions, layouts, colours, weights, capacities, appliance models, optional equipment, pricing and availability are indicative only and may vary between model years, production runs and individual Products due to manufacturing tolerances, engineering improvements, supplier changes or regulatory requirements. Photographs, videos, brochures, virtual tours and promotional material are illustrative only and may include optional accessories, upgraded finishes or dealer-installed equipment that are not included as standard. Where any inconsistency exists between information published on the Site and approved quotations, sales documentation, compliance information or owner’s manuals, the approved documentation will prevail. Nothing in these Terms excludes any rights that cannot lawfully be excluded under the Australian Consumer Law.

Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other applicable legislation where those rights cannot lawfully be excluded. Subject to those rights, and to the maximum extent permitted by law, Golf is not liable for any indirect, incidental, consequential or special loss arising from or in connection with your use of the Site. This includes, without limitation, loss of profits, revenue, business opportunities, goodwill, anticipated savings, reputation or data. To the extent permitted by law, Golf is not responsible for losses arising from: • reliance on information published on the Site; • temporary interruptions or unavailability of the Site; • cyber incidents or unauthorised access by third parties; • misuse, overloading or improper maintenance of Products; • unauthorised modifications or aftermarket alterations; • services provided by independent third parties or Authorised Dealers; or • circumstances beyond Golf’s reasonable control. Where legislation permits Golf to limit its liability for services supplied through the Site, our liability is limited, at our option, to re-supplying those services or paying the reasonable cost of having those services supplied again.

Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Golf, its directors, officers, employees, contractors and related entities against claims, liabilities, losses, damages and reasonable legal costs arising directly from: • your breach of these Terms; • your unlawful or improper use of the Site; • your User Submissions; • your infringement of another person’s rights; or • your breach of any applicable law. This indemnity is reduced to the extent that any loss is caused or contributed to by Golf’s negligence or breach of these Terms.

Suspension and Termination

Golf may suspend, restrict or terminate your access to the Site where reasonably necessary to: • protect the security or integrity of the Site; • investigate suspected misuse or unlawful activity; • comply with legal obligations; • perform maintenance or system upgrades; • protect other users; or • maintain the proper operation of the Site. Termination of your access does not affect any rights or obligations that accrued before termination. The provisions relating to intellectual property, privacy, disclaimers, limitation of liability, indemnity, governing law and any other clauses intended to survive termination will continue to apply.

General Provisions

Golf may amend these Terms from time to time. Updated Terms take effect when published on the Site unless otherwise specified. If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. A failure or delay by Golf to exercise any right under these Terms does not constitute a waiver of that right. Golf may assign or transfer its rights and obligations under these Terms without restriction. You may not assign your rights or obligations without Golf’s prior written consent. Golf is not responsible for delays or failures resulting from events beyond our reasonable control, including natural disasters, industrial action, supplier failures, utility outages, cyber incidents, government action or other force majeure events.

Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth courts of Australia sitting in Victoria in relation to any dispute arising out of or in connection with these Terms or the Site.

Where legislation permits Golf to limit its liability for services provided through the Site, Golf limits its liability, at its election, to the re-supply of those services or the payment of the reasonable cost of having those services supplied again.
